Hi Guys,

I know that almost everyone is downloading software and movies from net using torrents. :)

I want to know what kind of possible legal issues we may have to face now or in near future for downloading pirated movies and software. If we face one, how fatal it will be?

no one do download here, at least as far as I know all active members are in serious Hi-fi stuff. They dont mind purchasing BD for 1500 rupees.

Please dont download junk stuff and waste your money & time. There are better options available.

No its not. He's just asking for implications of downloading pirated movies, not asking you how to or from where to do so. someone asks what is the punishment for murder, and you say murderer:lol:

Legally, you could be arrested and prosecuted for stealing content etc. If porn is found on your PC, you could be in jail for having such things on your PC. i am sure some lawyer on the forum can tell you the exact law.

Here it goes: As per Section 65 of IT Act 2000, if one does copyright infringement, he will be liable to be punished with imprisonment that may extend to 2 yrs. and with fine, but the prosection has to prove the act of infringement beyond reasonable doubts with cogent proof.

Under Sections 292 and 293, you will be liable for punishment if you are in possession of any obscence materials in any form or fashion, with the exception of material used for any educational or religious purposes and the burden of proof lies on the accused to prove beyond reasonable doubts that they are of no illegal purpose other than educational or religious.

I'm sorry that it hurt forum members. Actually I mean people around me. (Friends and colleagues).

They just download anything using torrent just like shopping without any fear and worry. I asked this because in India any special cyber laws are exist to monitor these kind of traffic.

Torrants themself are not illegal, since the torrent itself does not contain the file but contains specific information that multiple computers in the network can read and send various parts of the requested file simultaneously.

The protocol that bittorrent uses to share files in itself is not illegal much like P2P, BUT, the content you download if that is copyrighted material THAT become illegal.

There are loads of legitimate stuff like Linux that are distributed using torrents in order to save bandwidth, so saying that Torrent is illegal would be wrong........ The content is what that matters...

yeah so it's illegal to download movies and music using torrents, as sam said torrents are not illegal, but if it's a movie or a piece of music, the chances are that you're infringing copyright. we've also got some draconian amendments to the IT Act recently to enable the government to 'big brother' everyone, but whether it will actually be used to tackle 'piracy' is anyone's guess.

And lastly about how 'fatal' the legal issue will be, it's unlikely to be fatal, because there is no death sentence for piracy ;)

Draconian?!!

Recently it was published in papers that if a consumer or shopper is caught purchasing pirated CDs he would be arrested under the GOONDA ACT!! Nobody took to the streets and forced the government to retract it, media made no noises about it!! :rolleyes:

I dont know about your credibility as CBI officer. I dont care either. You are trying to bully a person who has asked a simple question. If u r REALLY from what you claim to be then tell us r u short of work. People in every second household/cyber cafe etc are downloading this stuff. Dont have to ask the address here. You appeared like a desperate person who has to prove his credibility at work. If you are serious at your work then dont bully innocent people. I am sure what you did is against the forum rules.
This question may well be asked in any entrance exam. I am sure you also studied about the legality and some body enlightened on this.

Nevertheless, The torrents are indeed illegal and causes an infringement of copyright. So does the pirated CDs/DVDs being sold at most of the street music shop. Most of the torrents are also likely to be infected with some serious virus/trojans etc. The members here work towards achieving the highest level of satisfaction in Audio and visuals. Such kind of contents are a MUST STAY AWAY being illegal and extremely poor in quality.

Secondly, Cybercrime Bureau of Investigation:lol:,there is no such Dept in entire India....there are separate cells.
But who knows...it is obvious that cyber cells are monitoring most internet activities such as chat rooms, emails, blogs and forums:eek:hyeah: tooo...
