Something seems amiss here. All cess on CVD i.e. ones listed at Serial No. 3&4 (2%+1%) should work out to 3% of the 8% (So it would work out to 0.24% of the total cost) and not 3% of 100%

Same is the case with cess on customs listed at 5&6 above are on 10% of the cost of goods It should work out to 0.3% and not 3% of 100%

Any comments?
 
Hello Captain,

I think the VAT @ 12.5% and Octroi @ 5.5% are killer. Those items together account for 18% custom duties.

I dont know what C.V.D stands for, can you elaborate?

Something seems amiss here. All cess on CVD i.e. ones listed at Serial No. 3&4 (2%+1%) should work out to 3% of the 8% (So it would work out to 0.24% of the total cost) and not 3% of 100%

Same is the case with cess on customs listed at 5&6 above are on 10% of the cost of goods It should work out to 0.3% and not 3% of 100%

Any comments?
 
Counter vailing duty (as I understand) is applicable where a country (like for example China) subsidises a product manufactured by a company from it's country with an intention to give it an unfair price advantage in the market of the country that is importing the goods.

In our case, this thing is not applicable at all. Then why should it be charged in the first place?:mad::mad::mad::mad:

I suggest we recall the adage about the inevitability of taxes and death, and get on with this business. Never ever try to fathom Indian tax laws. Unless of course you have the constitution of an ox and the ability to read and understand superthick tax tomes that get revised every year!

Having been a part of the Government for a considerable period, I know how interpretations are made. No way should countervailing duties are to be levied here.

I finally took some time off to meet the Additional Commissioner of Customs. Got the information straight from the Horse's mouth. Will post the complete details tomorrow as I left the paper where things were jotted down at office.:o
 
Hi guys here is the update.

I met the Additional Commissioner of customs to present our case. I took the following papers: -

1. List of Participants.
2. List of items that are being imported.
3. Kit wise summary of costing of the components.
4. Pictures of the speaker kits, subwoofer drivers and Plate amps.

After hearing the preamble and our requirement, he has suggested two ways of going about and also suggested the easier way out of the two: -

First way
There is no need to have an IE code. It is not feasible to assess so many individuals importing on a single pallet. Instead, the group can nominate a co-ordinator and he can import of behalf of the group without IE code as an individual (As a special case) However, papers need to be bulletproof. As per chapter 85, the details of levies would be as under which need to be paid for: invoiced cost, freight and insurance up to the port of entry (Chennai): -

1. Basic Customs ......... 10%
2. Countervailing duty... 10% (levied on all imports to protect domestic industry)
3. Cess on the above....4.42%

We can import ourselves if we are well versed with the procedures; if not, we have to appoint a clearing agent who are termed 'Customs House Agents' to file the 'Bill of Entry'

Second way (Not very practical due to the procedures involved)

Since I reasoned with him about the definition of CVD and also stated that these kits are of Indian origin, he said that the speakers can also be reimported by the same person/firm which has exported it. The reimporter needs to establish the facts by submitting the following papers which will be examined and exemption would be granted. The time limit of reimport of goods is 3 years from the date of export.

1. Original / copies of shipping bills.
2. Proof of payment of Central Excise duty.

However, till the process is over, the pallet would be lying in their warehouse which would attract demurrage which could be very heavy depending on the time taken. 'Destuffing' i.e. taking out just our pallet since it LCL cargo (Less than Container Load) can be taken but apparently it is not safe and the cargo can get stolen as there is no mechanism for safe custody.

Considering the above facts, it would be prudent to undertake the first option for importing our kits IMO. So the approximate costing would be like this:

1. Customs.......................................................... 24.62%
2. Clearing agent.................................................. 10%
3. Insurance........................................................ ? (Hope Danny absorbs this too:D)
4. Repacking, local transport and incidental expenses... 2% (My assumption)

I propose to close the Group buy and give a window of 10 days for making payments to Danny directly.

@Participants, do voice your opinions on the thread.

If i understand correctly through the first method the customs would be around 37% instead of the 42% proposed by Peerless.

Did you also get any information about typical clearing agent charges if we need one?

How did you arrive at 37% figure?:confused: It is 24.42 + typically 10% for the clearing agent. The incidental expenses would be more or less similar to that of Peerless deal.

Did you also get any information about typical clearing agent charges if we need one?

Don't worry about that. There would be dime a dozen at our beck and call.:cool:

37 = 24+10+2 etc - he means total overhead.
I think this is fine given that it includes everything - shipping and customs, plus it is a DEAL from Danny to begin with.
Agent needs to be trustworthy, and should be paid only after our work is done. I do not know if 10% is lucrative enough given our order would be much smaller than typical orders these guys would be handling. But still we can negotiate.

I think the overall customs is bound to be around 34-35%.
Several DIYers who have imported loudspeaker components in the past have reported that the customs charged was 13% It is quite evident that they have been charged only basic customs duty of 10% and the education cess etc which works out to another 3% whereas in our case, even countervailing duty is being levied probably because of the size of the consignment. So my friend who was GM of the freight forwarding company was right when he said that we should break our consignment in smaller packets it appears. The silver lining is that we are saving substantial amount on freight which is actually higher than the drivers themselves, had we opted the courier mode. Check these posts: Query & Reply.

Not withstanding the advantages, there is something called appellate body to redress grievances of excess customs and we can knock their doors as our consignment is legitimate import for individual usage and also, the drivers were originally manufactured on our soil.
